202

Suggestions to the new government of India
Suggestion No.202.
We did a mistake in 1955-56

We had appointed Sharda Committee to enact laws on marriage, adoption, succession, guardianship and maintenance and they gave us four Acts.  We had added word ' Hindu' when in fact there is nothing concerning ' Hindus' in those Acts.  As far as ceremonies of marriage are concerned, those could be having some traditions amongst Hindus and this portion of those enactments could have been open for other religions in India.  As far concepts of one marriage, concept of divorce, concept of judicial separation, concept of maintained, concept of succession etc. etc. are common to all  and had this been done then there could have been no objections from other quarters.  Even the Muslims are having one wife system and only some rich have more than one wives and there are traditions amongst Hindus too that they had been having more than one wives, but when this act came into being, they accepted this system and had got no objections.  Even the divorce system had been accepted by Hindus.  And there, even today we can change the names of all those four Acts and the word 'India or Hindustan' could be prefixed and these Acts shall work as Common Civil Code.
